PROBLEMS OF IMPROVING THE FINANCIAL LEGISLATION OF UKRAINE IN THE CONDITIONS OF EUROPEAN INTEGRATION CHALLENGES

The article analyzes the problems of harmonizing financial legislation with the standards of European Union law. It is emphasized that of all the components of the EU financial acquis, Ukraine has currently implemented the general principles of legal regulation of the financial services market to the greatest extent. As a result of the analysis, a characteristic feature of financial legislation during the period of the legal regime of martial law was identified – regulation of the special procedure for the functioning of the financial system of Ukraine under such conditions, efficiency, simplification of budget and tax procedures, and strengthening control over the use of public finances. Some imperfect norms of budget and tax legislation have been identified, in particular regarding the application of financial responsibility. Among others, the following problems are highlighted: duplication of control powers of the Accounting Chamber, the State Audit Service of Ukraine and the National Agency for the Prevention of Corruption; imperfect regulations on mechanisms for the exchange of financial information, tax administration, financial control and supervision, and financial monitoring. Ways of improvement are proposed that take into account European standards in these areas. Attention is drawn to the need to revise and improve the conceptual and categorical apparatus – updating established financial and legal categories and concepts and defining those that have recently entered scientific circulation. The need to develop a draft and adopt a law «On Public Finances», which will certify the alignment of Ukraine’s financial legislation and the practice of its application with European standards, was noted. A conclusion is made about the prospects for harmonizing the financial legislation of Ukraine with European law in the conditions of martial law and post-war reconstruction, which require further development.
