ADMINISTRATIVE AND LEGAL REGULATION OF THE AGRICULTURAL LAND MARKET IN UKRAINE

The article presents a comprehensive analysis of the administrative and legal regulation of the agricultural land market in Ukraine, which has gained particular significance following the abolition of the long- term moratorium on the alienation of such land. The study reveals the historical and legal prerequisites of the land reform, outlines the characteristics of the formation of the modern regulatory framework governing the functioning of the market, and examines the role of the state in maintaining a balance between the economic freedom of market participants and the protection of the state’s strategic resource.The paper provides a detailed examination of the system of public authorities responsible for regulating the land market. It analyzes the powers of the Cabinet of Ministers of Ukraine in shaping state policy, the competence of the Ministry of Agrarian Policy and Food in coordinating the sector, as well as the functional responsibilities of the State Service of Ukraine for Geodesy, Cartography and Cadastre (StateGeoCadastre) in maintaining the land cadastre and ensuring compliance with land legislation. The article describes administrative procedures that ensure the legality of land circulation, including registration actions, land management procedures, approval of documentation, digital services, and the mechanisms of land auctions.The analysis identifies key problems that hinder the effective implementation of administrative and legal mechanisms. Among them are the fragmentation of the regulatory framework, insufficient interoperability among state registers, inadequate quality of cadastral data, shortcomings in state control and supervisory procedures, and the presence of corruption risks within the sphere of land relations. The article also highlights challenges associated with the potential excessive concentration of land in the hands of large market players and the risks this poses to the development of small farming enterprises.The concluding section formulates proposals for improving the administrative and legal regulation of the agricultural land market. The author substantiates the need to modernize the infrastructure of the land cadastre and state registers, digitalize control and registration procedures, expand the availability of open data, enhance the transparency of public administration, and strengthen liability for violations of land legislation. It is emphasized that the comprehensive improvement of administrative and legal instruments is a key prerequisite for the formation of a competitive, stable, and European-standard-oriented agricultural land market in Ukraine.
